Assisted Probate = as much or as little help as you need, paid along the way.
Grant only – you supply the information, and once the Grant is obtained, the executors collect in the assets, pay the bills and distribute to the beneficiaries. Payment must be made before the Grant is passed on.
Full service – payment will normally be collected from the estate and the lawyers will deal with most things once you have supplied the essential information.
Where matters become unavoidably contentious, we can refer you to other firms that specialise in contentious probate. We should also mention that a great deal of our associates’ work is in Estate Planning, trusts, asset protection etc, so we can help the living plan effectively, as well as point you in the right direction in sorting out the affairs of the deceased, perhaps with fixed fee probate quotes. The firms we recommend offer two main options:
- Professionally Assisted Probate – the family do the easy bits and sends the paperwork in for the firm to check through and put together. They do as much or as little as you wish in providing probate advice to support you.
- Full Service – we find a firm to get everything done, if that is what suits you, and take as much as possible of the burden away from the family. Depending on the area, hourly rates are typically 22 to 50% lower. More importantly, where tax may be an issue now or will be eventually for the beneficiaries, we can arrange to have a Tax expert available to minimise current and future tax burdens. Very few firms have such a facility.
